MORITORIUM UPDATE: 

On Friday, June 11, the Governor published an Executive Order that makes the following changes to Evictions and Collections.
Currently, a person cannot commence or continue a residential eviction against a Covered Person (a tenant that returns a signed Tenants Declaration to the landlord) unless that person poses a direct threat to the health and safety of other tenants or an immediate and severe risk to the property.  This has not changed in the most recent Governor’s Executive Order.  However, please note the following changes that are included in said Executive Order:

  1. The Sheriff can now execute physical evictions on tenants whose eviction orders were entered before March 20, 2020.
  2. Beginning on June 26, 2021, the Sheriff can execute physical evictions on tenants who are Non-Covered Persons (tenants who fail to provide a Tenant’s Declaration to the landlord).
  3. Beginning on June 26, 2021, an eviction lawsuit can be filed against a Non-Covered Person (a tenant who fails to provide a Tenant’s Declaration to the landlord) who does not owe rent.  Currently, a lawsuit can be filed against a Non-Covered Person only if they also owe rent, unless they pose a direct threat to the health and safety of other tenants or an immediate and severe risk to the property.
  4. The Moratorium on Citations, Garnishments, and Rules on consumer debtors ends on June 26, 2021.
